1. The Website

1.1 This Website (the “Website”) is maintained by Sanjeev Sinha Foundation, a non-profit art organisation registered in India and located in #205, 2nd Floor, Capital T, Fraser Road Patna G.P.O, Phulwari Patna, Bihar, 800001 India.

 

1.2 Before you start to use the Website, please read the terms of use set forth herein (referred to as “Terms”) which informs you of the terms on which you may make use of the Website.

 

1.3 Use of the Website by you is deemed acceptance of the Terms and you agree to be legally bound by the Terms and to comply with the Terms, without limitation. If you do not accept the Terms in full, you must leave the Website immediately.

 

2. Changes To Website

The Terms may be changed by Sanjeev Sinha Foundation from time to time at its sole discretion without notice to you. If the Terms are changed (such changes shall be deemed to form an integral part of the Terms), the new version of the Terms comes into force and will be enforceable from the day it is uploaded on the Website and the continued use by you of the Website following the posting of any changes to the Terms constitutes your acceptance of those changes. Any new features or tools added to the Website shall also be subject to the Terms then in force.

3.1 Sanjeev Sinha Foundation cannot confirm the accuracy of any information on the Website or whether such information is complete or up to date at any given time. Sanjeev Sinha Foundation may at its sole discretion update or remove any information on the Website from time to time.

Accordingly, Sanjeev Sinha Foundation may at its sole discretion: (i) remove any content from the Website, or (ii) close the Website, or (iii) restrict or suspend access to some parts of the Website or the entire Website.

Each registration with Sanjeev Sinha Foundation is for a single user only. If you choose, or if you are provided with a password or any other piece of information as part of Sanjeev Sinha Foundation’s security procedures, you must treat such information as confidential and you must not disclose it to any third party. Because security and access rights are important to Sanjeev Sinha Foundation and you, Sanjeev Sinha Foundation has the right to disable any password, whether chosen by you or allocated by Sanjeev Sinha Foundation, at any time, if in Sanjeev Sinha Foundation’s opinion you have failed to comply with any of the provisions of these Terms.

5. Intellectual Property Rights

5.1 Sanjeev Sinha Foundation owns all intellectual property rights to the Website and all of its information and material pertaining to the Foundation and its programmes, including but not limited to, text, articles, images, logos, trademarks, trade names, copyright works, designs and inventions (whether they are registered or not) (the “Published Information”). Sanjeev Sinha Foundation reserves all its intellectual property rights. Sanjeev Sinha Foundation does not own but has permission to use all of the information pertaining to artists, authors and institutions who retain copyrights to the said information including but not limited to, text, articles, images, logos, trademarks, trade names, copyright works, designs.

5.2 You may access, download and temporarily store the Published Information for the sole purpose of personal viewing, non-commercial research, information, use or education, with no addition or amendments.

5.3 You must not use the Website or its content: (i) for any unlawful purpose, or (ii) for any purpose which is offensive or disrespectful, or (iii) to harass, abuse, insult, harm, defame, slander or intimidate others, or (iv) to spam, or to otherwise interfere with the security of the Website or any website related to Sanjeev Sinha Foundation, other website or the internet. Sanjeev Sinha Foundation reserves the right to terminate (without any liability whatsoever) your use of the Website or any website related to Sanjeev Sinha Foundation for violating any of the prohibited uses.

6.1 Only authorised Sanjeev Sinha Foundation staff can upload images and other materials to the Website.

6.2 The intellectual property rights in (including the copyright over) photographs, or any other materials, uploaded to the Website is the property of Sanjeev Sinha Foundation and/or the copyright holder.

6.3 Sanjeev Sinha Foundation is not responsible for loss or corruption of data, including accidental or intentional deletion by Sanjeev Sinha Foundation.

11. Applicable Law & Jurisdiction

The Terms, the Website and any information contained in it will be governed by the laws of the Emirate of Dubai and the applicable Federal laws of the United Arab Emirates, and the courts of the Emirate of Dubai will have exclusive jurisdiction to hear any dispute arising from the Terms; provided however, notwithstanding the foregoing, Sanjeev Sinha Foundation shall also be entitled to initiate legal proceedings in the court(s) of any country.

12. Entire Terms

The Terms constitute the entire agreement between you and Sanjeev Sinha Foundation in relation to the use of the Website and supersede all previous terms in respect of same.
